Never pay a collection before disputing
Paying resets the 7-year clock in some cases and rarely removes the entry. Always dispute first, validate second, negotiate pay-for-delete last.
The debt validation letter
Under the FDCPA you have 30 days from first contact to demand full validation — original creditor, chain of custody, signed contract. Most Miami collectors like LVNV Funding and Portfolio Recovery can't produce it.
Pay-for-delete in writing only
Never accept a verbal promise. If a collector agrees to delete for payment, get it on their letterhead before the wire goes out.
Statute of limitations in Florida
Florida's SOL on written contracts is 5 years, oral contracts 4 years. Collections older than that are legally unenforceable — a huge lever for North Miami clients with old debts.
